1. Acceptance of Terms

By accessing or using PoolMGMT ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all users, including homeowners and pool service professionals.

2. Description of Service

PoolMGMT is a marketplace that connects homeowners with independent pool service professionals. We facilitate bookings, payments, and communication between parties. PoolMGMT is not a pool service company and does not employ pool professionals — they are independent contractors.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when registering. You may not share your account with others.

4. Pool Professional Verification

Pool professionals on the Platform undergo a verification process that may include license checks, insurance verification, and background screening. While we make reasonable efforts to verify credentials, PoolMGMT does not guarantee the accuracy of any professional's credentials or the quality of their services. Homeowners are encouraged to conduct their own due diligence.

5. Payments and Fees

All payments are processed securely through Stripe. Service packages are purchased in advance as visit buckets. Prices are set by individual pool professionals and may vary. PoolMGMT may charge a platform fee on transactions. All fees are disclosed before you complete a purchase.

6. Cancellations and Refunds

Homeowners may request refunds for unused visits at any time. Pool professionals will process approved refunds within 5-10 business days via the original payment method. Refund approval is at the discretion of the pool professional, and they may offer a discount on future services as an alternative. PoolMGMT platform fees are generally non-refundable. 7. Prohibited Conduct

• Using the Platform for any unlawful purpose
• Posting false, misleading, or fraudulent information
• Circumventing the Platform to arrange off-platform payments
• Harassing, threatening, or abusing other users
• Attempting to gain unauthorized access to any part of the Platform

8. Limitation of Liability

PoolMGMT is a marketplace platform and is not responsible for the actions or omissions of any pool professional or homeowner. To the fullest extent permitted by law, PoolMGMT's liability for any claim arising out of use of the Platform is limited to the amount you paid in the 30 days preceding the claim.

8a. Property & Premises Disclaimer

PoolMGMT is not responsible for any damage, injury, loss, or liability arising from a pool professional's presence on or access to your property, including but not limited to your backyard, pool area, equipment, landscaping, pets, or any other personal property. Any damage or disputes arising from a service visit are solely between the homeowner and the independent pool professional. PoolMGMT assumes no responsibility for incidents that occur on private property during or after a service visit.

8b. Independent Contractor Disclaimer

Pool professionals listed on PoolMGMT are independent contractors, not employees, agents, or representatives of PoolMGMT. Any opinions, advice, recommendations, or statements made by a pool professional — whether on the Platform, in messages, or in person — are solely those of the individual professional and do not reflect the views, positions, or endorsements of PoolMGMT. PoolMGMT does not control the work methods, conduct, or communications of pool professionals and expressly disclaims any liability for their statements or actions.

9. Intellectual Property

All content on the Platform, including logos, text, and software, is the property of PoolMGMT or its licensors. You may not copy, reproduce, or distribute any Platform content without prior written consent.

10. Termination

PoolMGMT reserves the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will notify users of material changes via email.
